this 911 call came in late last night. the report of a body found down at the bottom of a light shaft at an apartment building here on biltmore street. now there is a rooftop patio on top of this building. neighbors have told news4 that people were up on top of the roof celebrating on new year's eve. police were here on the scene until about 2:30 this morning collecting evidence and trying to identify the body that was found. one of the things they're looking into is the possibility that it might be 23-year-old michael poe of poolesville. poe has been missing since new year's eve. family and friends were out in the adams-morgan area yesterday posting flyers with his picture, looking for information on his whereabouts. poe was celebrating new year's eve in adams-morgan with a group of about 20 friends. he left shenanigans bar at around 12:30. that's when he parted ways with his group of friends. now he did place a cell phone call at 2:30 in the morning, but that was the last time that anyone heard from him. again, police trying to piece together exactly what has

happened here at this apartment complex, trying to identify the body, figure out if the person that was found here at the bottom of that light shaft is indeed michael poe. as of yet, they have not released names, have not made any identification. so still an open investigation. reporting live in adams-morgan, megan mcgrath, news4. back to you. >> thank you. this is expected to be an emotional day in newtown, connecticut. students and staff will return to a new sandy hook elementary school this morning. officials moved classes to an empty middle school building a few miles away. crews spent the last few weeks trying to remodel the school to look like the old sandy hook. last month the gunman killed 20 children and six staff inside the old building. today counselors will be available as students arrive, as well as heavy police presence. parents will be allowed to stay with their children to help with the transition. a maryland task force recommends new gun laws for mentally ill people who make threats. the general assembly appointed the panel last year. the group says police should be authorized to take weapons after

a specific threat. if that person doesn't have a gun, that person should be blocked from buying one. a spokesperson for maryland governor martin o'malley said he'll use the report as agated for a gun control -- a guide for a gun-control legislation package. new this morning, the debate over the fiscal cliff is behind us at least for the time being. overnight, president obama signed into law a bill which prevents taxes from going up on 98% of americans. it also defers billions in spending cuts for two months. the president signed the bill in hawaii where he resumed his vacation shortly after the house approved the measure, hours after 2013 started. you can can expect more negotiations, though, over taxes and spending in the coming weeks, especially with economists warning that the government must do more to lower its deficit, or it risks losing its top credit rating. president obama also has signed a defense bill for the coming year. the $633 billion bill boosts security at diplomatic missions around the world. that's in response to september's deadly attack on the

u.s. consulate in benghazi, libya. the president had threatened to veto the legislation. he had issues with several provisions including one that limits his authority to transfer terror suspects from the military prison in guantanamo bay. we are tracking breaking news out of pakistan right now involving the death of a high-ranking taliban leader. also ahead this morning, the offer made to the families of the colorado theater shooting victims that some are calling insensitive. talk about a clearance sale, pieces of nasa history that are available to you if the price is right. we are waking up to temperatures in the 20s.

there is more breaking news. this time a man shot and killed three people, injured two others in switzerland. this shooting happened in the southwestern part of the country. once police got to the scene, the gunman pointed his weapon at the officers, and ey shot and i when they shot and injured the gunman. he's in custody. three people died on the scene. two others were taken to the hospital. no word on their injuries. relatives of people killed in last summer's colorado theater shooting have rejected an invitation to attend a memorial. since mark theaters invited family members to attend an evening of remembrance at the aurora theater when it reopens january 17. relatives of nine of the 12 victims released a statement angrily rejecting the invitation. the mother of one of the victim called it "a disgusting offer." >> they want the public relations ploy of having us there to support their grand reopening when none of us are interested in ever stepping foot in that theater, that killing

field ever again. >> prosecutors in colorado will outline their case against accused gunman james holmes at a preliminary hearing next week. justin bieber is calling for a crackdown on paparazzi after a photographer was killed trying to shoot photos of the pop star's car. the photographer died tuesday night. los angeles police say he was hit by a car shortly after taking pictures of bieber's white ferrari on the side of the road. bieber was not inside the car at the time. the pop star released a statement saying he hopes the tragedy will lead to a new law that will protect the lives of celebrities as well as photographers. new this morning, the six men accused in the gang rape and killing of a 23-year-old in india are due in court. police are expected to charge the five men -- five adults with murder. among other charge in the attack that killed a medical student. a sixth suspect is a minor. no word whether he will be charged as an adult. the woman was attacked on a bus last month in india. she died from her injuries. prosecutors will likely seek the death penalty in this case.

right now, police in montgomery county need your help to find a missing man. take a look at this picture. 43-year-old frank herschel was last seen at around 3:45 yesterday afternoon at his home in the 6 00 block of southport drive in bethesda. he's without his medication. his family is concerned for his well-being. he's 5'10" and 170 pounds. police do not know what he was wearing when he went missing. if you have information about this man, contact montgomery county police. 17 after the hour now. in the day ahead, family, friends, and colleagues will say good-bye to a prince william county police officer killed in the line of duty. a wake for officer chris young will be held from 6:00 till 9:00 tonight at the hilton memorial chapel in woodbridge. his funeral is set to happen at the chapel tomorrow morning at 10:00. young was killed on monday afternoon when he collided with a minivan while responding to a call. he leaves behind a wife and three children. secretary of state hillary clinton is out of the hospital this morning after spending four days there for a blood clot.

clinton was seen smiling inside a van as it pulled away from new york presbyterian hospital last night. doctors believe the blood clot developed after clinton fainted and hit her head in december. she's expected to make a full recovery. about a dozen people who survived a bus crash that killed nine others in oregon are back home in canada. the survivors arrived home last night in an suv convoy. they did not want to board another bus. they were on a tour bus sunday heading back to british columbia from las vegas when the bus hit a guardrail and flew some 200 feet down an embankment and rolled over. 14 people are still in the hospital. 5:18 now. congress could approve billions of dollars in aid for victims of sandy by this weekend. house speaker john boehner schedule a vote for tomorrow on a measure to allocate $9 billion for the national flooding insurance program. the house will voted in a few weeks on providing another $51 billion. democrats and republicans were furious with boehner for

in stories making headlines, a senior taliban commander is among the dead after a pair of u.s. drone strikes in pakistan. an emotional day in newtown, connecticut, as students of the sandy hook elementary school return to class. police are trying to figure out if a body found is that was a missing man. we'll have much more throughout the morning. first, good morning you to, i'm eun yang. >> i'm aaron gilchrest. welcome back to "news4 today" on this thursday, january 3. a traffic alert for drivers heading into northwest d.c. you could see big delays along wisconsin avenue because of a water main break. news4 has more live from chevy chase on more. tony? >> reporter: hey, good morning. i hate to be the bearer of bad news, but this is going to be one ugly commute for drivers headed into the district if you use 355 on into wisconsin. behind me you see a broken water

main they are fixing now. if you look, if you see the green piece of fabric, that's a filter that they're using to pump out the water to get a look at the main, see what the damages are and how they're going to repair them. this broke about 6:00 p.m. yesterday. they got it shut off around 8:45. but the reason for the delay in the repairs, they had to wait for utility to come out, clear them on the gas lines. then you see they actually had an unusual amount of concrete to dig through before they could actually get down to the hole and get to some of the water and get it drained out. now i'm told it an eight-inch water main. they say no customers are affected. i got to tell you, they're telling me this isn't going to be fixed until well into the afternoon. folks coming down 355 on to wisconsin, you're only going to be able to get by on one lane. make sure you plan accordingly. we're going to continue to stay on this all morning. for now, we'll toss it to alexis. >> reporter: all right. thank you, tony. looking at the overview here, no delays on the beltway. like tony was saying, two

was last seen. again, no identification or name has been released with respect to the body found on biltmore street. the investigation still ongoing. we are expecting police to return to the area to take a closer look and continue to collect evidence once the sun comes up this morningment reporting live in adams-morgan, megan mcgrath, back to you. >> thank you. today a virginia death row inmate expected to walk out of prison a free man. justin wolfe is scheduled to be released by 5:00 this evening. he was sentenced to death for the 2001 murder of drug dealer daniel petroli in prince william county. prosecutors say he hired owen barber to kill him and he testified against wolfe in exchange for a lighter sentence. in july a judge throughout wolfe's conviction saying barber lied. wolfe's parents say they are grateful for a second chance for their son. >> we're so relieved but still concerned over the next 24 hours. >> a federal appeals court could

still intervene to stop the release. in the day ahead, lawmakers get back to work as the 113th congress begins. here's a live look at capitol hill. swearing-in ceremonies will begin. shortly after lawmakers gather the house will vote on a speaker for the new two-year session. john boehner is expected to be re-elected to the position despite criticism from his own party party during the fiscal cliff negotiations. and d.c.'s delegate to congress will fight for her right to vote on the house floor as the new session opens. the draft rules for the 113th congress do not allow delegate eleanor holmes norton to vote in the committee of the whole which considers changes to legislation. that goes against the ruling of a judge and limits norton to only voting in committees on which she sits. today she will file a motion to force the house to examine the constitutionality of those rules. the fiscal cliff teal deal passed this week included a gift for local commuters. a provision raises the federal

benefit to take public transportation to $240 a month. most federal workers and some contract employees are eligible for that incentive. the benefit of just $125 a month in 2012 and was blamed for reduced ridership on metro and vre. the provision is also retroactive meaning federal workers may be able to recoup some of the extra costs they paid for public transit last year. virginia lieutenant governor bill bolling may not be giving up hope of becoming the commonwealth's next governor. the "washington post" is reporting that the republican is considering a run as an independent. he says he's been polling voters and meeting with business leaders to help him make a decision. bolling suspended his campaign for the gop nomination in november. that makes attorney general ken cuccinelli the presumptive republican nominee. it is now 5:36. 32 degrees. still to come, waiting to return home. the red tape that is keeping a virginia woman overseas. plus, the impact a court ruling will have on people who post reviews on web sites like

integrate the kids back to school. the new school is about seven miles away from sandy hook elementary school here in monroe. was an empty elementary school that crews for the past three weeks have been working to refurbish. just one of so many changes here again, they expect to start class around 9:00 this morning. a later start. it won't be a regular schoolday for these children. the lesson plan not all that important as you might imagine. the structure and getting back to some form of being together in the classroom and trying to work through some sort of routine is exactly what they're going to be working on for at least half a day. then the parents will come back and be part of what will be an open house type of situation where they can discuss exactly what's going on and how the process is going to work. there was an open house

yesterday, as well, for families just to get familiar with the new facility here. there will also be counselors on hand throughout the day and throughout the foreseeable future to talk with families that feel they need help. >> does it seem as though most families also want their children to start school again today? are you getting an indication that folks may not show up. >> reporter: no, i think they absolutely want these kids to get back together. i think they think that's important for them to move forward. i think i a lot of the family are also apprehensive. they don't know how this will work, and they're feeling like it's going to be difficult and maybe they'll take time, do a half day today or for the next week, trying to ease into the routine. again, there's no playbook, no way to detail how it's going to play out.

they're going to go today, see what happens, and move from there. >> thank you, jay. maryland governor martin o'malley will use a panel's report as a guide for his new gun-control package. the task force released its report yesterday. recommends giving police authority to take weapons from mentally ill people who make specific threats. they could be blocked from buying a gun. the panel said that health care professionals should be required to appropriate threats to law enforcement. an immigration battle over a visa is keeping a virginia man from his newlywed wife. adam ross and his wife got married three weeks ago. after the wedding, apena's mother got terminally ill and had to return to thailand before finishing the process. now she cannot return to herndon. ross says immigration officials could be more understanding. >> i haven't seen any humanity from any of these people that they really can't imagine themselves in my position.

they're just a result of very, very bad bureaucracy. >> ross says his elected officials have tried to help but so far, no luck. the virginia supreme court reversed a judge's ruling on negative online have views. yesterday the highest court threw out the injunction issued in fairfax county last month. deetz development is suing jane preresses over comments she put on yelp and angie's list. she said the contractor stole items and did subpar work. the owner says the statements are false. this morning, police arrest robbers who forced a u.p.s. driver to the floor of his truck at gunpoint. the attack happened yesterday at alabama avenue and ridge road. the men stole several packages from the truck. they were last seen driving off in a white cargo van. the driver was not hurt. and four men are wanted for question being a stabbing and assault on a metro bus. photos are from early new year's

morning. one of the men got into an argument with two women on the 93 bus. police say that he stabbed one woman and beat the other. the bus was headed toward congress heights. the men got off at martin luther king avenue. both women are expected to be okay. vultures causing problems in leesburg, virginia. take a look here. nearly 200 of the birds have set up nests around mayfair drive and plaza street in the northeast part of the town. police say the waste that the birds leave behind is a health risk. the birds can also damage buildings. starting next week, wildlife experts will try to move the vultures by setting off fireworks using lasers and noisemaker, as well. the daily operations will begin at 4:00 p.m. and last an hour. 5:50. the chesapeake bay appears to be on the mend. the chesapeake bay foundation says the bay's health is improving, giving it a grade of 32 out of 100. in the latest report, it may sound dismal but is a slight improvement from the grade it received in 2010. the chesapeake received a grade

working. construction to replace the station's three escalators is set for early 2014. there is new controversy surrounding speed cameras in the district. d.c. police sergeant mark robinson recently got two speed camera tickets while rolling through the 3rd street tunnel in his personal car. the 22-year veteran of the force says the speed dplarm that tunnel is not accurate. he says the trarm still has the normal speed limit of 45 miles per hour. the posted speed limit, though, dropped to 40 miles per hour because of construction. >> you have to enforce the posted speed. and it has to be accurate. >> robinson took this case to the dmv which agreed that there were discrepancies with the ticket and they should be tossed out. no word on what will happen to thousands of other similar tickets. starbucks is trying to clean up its act this morning by getting its customers to change the way they get their cup of coffee. cnbc has more on that and more. good morning. good morning. that's right.

starbucks wants you to reduce, reuse, and recycle. the coffee chain is rolling out $1 reusable plastic cups in the u.s. and canada today. the company also gives customers a ten-cent discount when they bring in reusable cups for a refill. now it hopes the new cups which resembles its white paper cups will murj people to increase that habit. in 2008 starbucks said it wanted to serve 25% of all drinks in reusable cups by 2015. meanwhile, bank of america is ramping up lending to consumers and companies after two years of focusing on cost-cutting and strengthening its balance sheet. the ceo, brian moynihan, tells the financial times b of a should surpass jpmorgan in direct mortgage lending in the next six months. he's directed bankers to be aggressive to lending to businesses. that could mean competitive loan rates.
